Terms of Service / Privacy Policy

Privacy Policy:

As a photographer, you are booking with me and with this gives me access to the following:

  • Your full name and your contact information; such as your phone number and email address.

  • Session details, such as preferred dates, locations, and other specifics needed to provide service to you.

  • Payment and billing information when you purchase services.

  • Photographs taken during our sessions.

  • Any other information that may be provided during the booking process, such as social media or other forms of communication.

I may use this information to:

  • Provide photography services to you.

  • Communicate with you thoroughly about your session; including payment, booking info, and other inquiries.

  • Maintain business and financial records.

  • Improve my website / build my portfolio.

What I will do with your photographs:

I will never use your photographs without your permission. Your photos that are taken during your session will never be sold to anyone for any reason without your permission and consent. If you give consent to your images to be used, they will be used to further build my portfolio and that is all.

I will never use any images of minors publicly without appropriate and definite consent from a parent / legal guardian of said minor.

I will never sell your personal information. I do not store your payment information personally. All payments are handled through third party payment providers.

Terms of Service:

  • I have the right to deny any request that does not align with my skillset or comfortability. I will never use my services to promote hate speech or violence.

  • A session is considered officially booked once the deposit has been made. This deposit is non refundable.

  • The remaining balance is due on day of session.

  • Dates and times are not guaranteed until the deposit has been made and your appointment has been confirmed.

  • All payments must be made through one of the payment methods provided in the contract.

  • I have the right to decline service if payments are not made by the required deadlines.

  • I have the right to charge additional fees for extra services, rush deliveries, prints, or other requested additions that were not in the original session.

  • Please message me as soon as possible if you need to cancel or reschedule your session. In case of severe weather, I will provide a new date for our session.

  • Arriving to the session late may reduce the amount of time available for our session. I am not required to extend our session due to your late arrival.

As the client, you are responsible for the following:

  • Arriving on time

  • Providing accurate locations, dates, and booking information

  • Following instructions during sessions

  • Supervising children and pets at all times

  • Informing me of any special circumstances or safety concerns that I may not be aware of.

As the photographer, I am responsible for the following:

  • I am responsible for editing all the images according to my personal style and preferences.

  • I am responsible for all the RAW / Unedited files and will never share these RAW / Unedited images with the client.

  • If further edits or changes outside my style are requested, I have the right to ask for additional charges to the original payment.

  • I can not guarantee any specific photograph, pose, expression, background, reaction, etc. from any person or animal. I will do my absolute best to make your visions come true, but I will not force anyone to do something that they are unwilling to do.

Image Delivery:

  • All images will be provided to you via digital download on pixieset.com

  • Delivery times may vary depending on complexity of session, technical issues, workload, or other circumstances out of my control. As the client, you are responsible for saving your images and backing them up once they have been delivered. I will not guarantee the personal permanent storage of your session’s gallery. Please save your images and back them up on your own time.

Copyright:

  • All images taken during our sessions are created by me, Madison Arcaro, the photographer, and are owned by me unless specified in other writing or agreement. Purchasing a session from me does not give you the full rights and ownership of these images. You have the right to use these images for personal use and other non commercial purposes. Please do not sell these images commercially without permission from me, Madison Arcaro, the photographer and owner of said images.

  • You have the right to download, print, and share your purchased images in any personal / non commercial way you please.

Social media and portfolio use:

  • If given the consent to do so, your images may be used for my social media and portfolio to help me further promote my business. I will never share your personal information within these social media posts. I will never sell your images to anyone. Your privacy is important to me.

Location / Travel:

  • Photos taken outside of Camden County, New Jersey, USA may be subject to additional travel fees depending on how far and how difficult it is for me to get to said location during set date and time. I have the right to refuse to travel to any location that I am unable to or not comfortable travelling to.

When booking with me, you are agreeing that you have read, understood, and agree with these terms of service. Further consent forms will be provided which will require you to read these terms of services once more and you will asked to provide a written or digital signature to confirm that you agree with my policies.
